Availability varies by Product, configuration, subscription, deployment, and Connected Service.

Customer Responsibility for AI Use

Customer is responsible for determining whether AI Features are suitable for a particular use.

Customer must review AI Outputs when accuracy, legal compliance, safety, reputation, financial impact, publication, customer communication, or another material consequence depends upon the output.

Customer must not represent AI Output as independently verified fact unless Customer has performed appropriate verification.

AI Output may contain inaccurate, incomplete, outdated, duplicated, biased, or unexpected information. Customer must apply appropriate human judgment before relying on AI Output for consequential purposes.

AI Inputs

Customer must have the necessary rights and authority to submit AI Inputs.

Customer must not intentionally submit:

  • information obtained unlawfully;

  • confidential information Customer does not have authority to process through the applicable AI Feature;

  • authentication credentials, passwords, private keys, secrets, or security tokens unless the Product expressly requires such information through an approved secure mechanism;

  • regulated or sensitive information where use of the applicable AI Feature has not been approved for such information;

  • malicious instructions intended to compromise BWA, another Customer, a Connected Service, or an AI system; or

  • information intended to defeat security, privacy, tenant-isolation, moderation, or access-control protections.

AI Generated Content

Customer is responsible for Generated Content that Customer chooses to publish, distribute, send, execute, incorporate into another system, or otherwise use.

Before publication or operational use, Customer must take reasonable measures to confirm:

  • factual accuracy where accuracy matters;

  • appropriate attribution where required;

  • compliance with applicable intellectual property rights;

  • compliance with applicable privacy and confidentiality obligations;

Customer must not configure an Automated Action to:

  • access information beyond Customer’s authorization;

  • circumvent approval, authentication, financial, security, privacy, or compliance controls;

  • send deceptive or unauthorized communications;

  • execute transactions or publish information outside the scope intended by Customer;

  • modify or delete information without appropriate authorization;

  • continuously repeat actions in a manner that creates excessive traffic, cost, resource consumption, or service degradation;

  • conceal the identity or origin of automated communications where disclosure is legally required; or

  • take unlawful actions merely because those actions have been delegated to software.

Customer should use appropriate approval controls for actions with material legal, financial, operational, privacy, security, employment, healthcare, safety, or reputational consequences.

High-Impact Decisions

Unless expressly agreed in writing and configured for the applicable use case, Customer must not use AI Features as the sole basis for decisions that produce significant legal or similarly material effects concerning an individual.

Where AI Features support a high-impact workflow, Customer remains responsible for required human review, notices, explanations, consent, appeal processes, record keeping, and other legal obligations applicable to Customer.

Misrepresentation and Synthetic Content

Customer must not use AI Features to intentionally:

Where required, communications must contain accurate sender information and an appropriate method for recipients to exercise applicable opt-out rights.

Transactional communications may be subject to different legal requirements.

Build with Advantage Trademark Use

Unless Customer has prior written authorization, Customer may not use, remove, alter, or misrepresent any Build with Advantage or Enginess name, logo, trademark, service mark, tagline, identifier, attribution, or Product-generated branding.

Customer must not use BWA branding:

  • in a manner that implies Customer is Build with Advantage, Enginess, or an employee, contractor, agent, partner, or representative where such relationship does not exist;

  • to mislead another party regarding sponsorship, certification, affiliation, or endorsement; or

  • in any manner inconsistent with applicable trademark or branding requirements.

This section does not prevent use expressly enabled by Product functionality or authorized under Customer’s agreement.

  • preserve or disclose information where required by applicable law.

Where legally permitted and reasonably practical, Build with Advantage will provide notice of material enforcement actions affecting Customer.

Resource and Fair Use

Build with Advantage aims to provide reliable service across Customers and may monitor resource consumption, including bandwidth, storage, compute, API traffic, AI usage, search indexing, automation volume, and other infrastructure usage relevant to Product operation.

Usage allowances and limits depend on Customer’s applicable subscription, order form, hosting arrangement, or service agreement.

Customer must configure its implementation in accordance with applicable privacy and data protection requirements.

Where AI Features or Connected Services process Customer Data, applicable processing arrangements, privacy terms, subprocessors, deployment configuration, and Customer-selected integrations determine how information is processed.

This AUP does not replace the applicable Privacy Policy, Data Processing Agreement, service agreement, or other contractual privacy terms.

BWA Products continue to evolve.

Build with Advantage may add, modify, replace, or discontinue functionality in accordance with Customer’s applicable agreement.

AI models, Connected Services, APIs, browsers, operating systems, infrastructure providers, and other external dependencies may also change independently.

Customer is responsible for testing Customer-specific implementations and integrations where such changes materially affect Customer’s use.

Updates to this AUP

Build with Advantage may update this AUP from time to time.

The current version will be published through Build with Advantage’s applicable legal or Product channels.

Where required by Customer’s agreement or applicable law, Build with Advantage will provide notice before material changes take effect.

Continued use of the Products following the effective date of an updated AUP constitutes acceptance of the updated AUP to the extent permitted by Customer’s agreement and applicable law.
